End User License Agreement

By submitting material to MUSICFREEDOM.com you represent and warrant that:

• You have the rights and/or have secured the rights by all third party consents, licenses, and permissions necessary to enter into and perform under this agreement.
• The material does not or will violate any laws, regulations or statutes.
• The material you submit does not contain any “Samples” unless you have secured a master recording clearance.
• The material does not infringe on any copyrights.
• The material does not contain “Hate” (regarding to race) content. We do not tolerate ANY racism.
• You are responsible for any and all material that you submit in full. (e.g. you upload someone else's song or use a “Sample” or did not have the rights to submit, we have the right to reveal any information we have to the RIAA or any government agency that requests it.)
• You have the right to request removal of your material as we will do so upon receiving such a request.
• You will not use MusicFreedom.com in an illegal manner in any way.
• You will not defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others.
• You will not publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, username, or any other material which might otherwise subject MusicFreedom.com to public disparagement or scorn.
• You will not falsify or delete any author attributions, legal or other proper notices or proprietary designations.
• We have the right to delete your posts and/or terminate your access at any time without notification.
• We disclaim any responsibility for the deletion, failure to store, mis-delivery, or untimely delivery of any information or material.

You give permission to MUSICFREEDOM.com to:

• Host your material on our servers.
• Display your materials to MusicFreedom.com users on our Web site and printed material, in whole or in part, alone or in compilation with content provided by third parties.
• Re-encode your materials.
• Edit your materials (but not your music) to ensure that they comply with our policies and guidelines.
• Use any information on your profile including (Music, MF Interviews, Photos, Show Dates) but EXCLUDING (Blogs and any 3rd party recorded interviews) to be used on promotional CDs and promotional videos.
• Use any trademarks, service marks, or trade names incorporated into your material and use the likeness of any individual whose performance or image is contained in your material. We do not have the right to sublicense your audio-visual materials other than as necessary to syndicate our sites to our business partners.

WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
